A pre-construction property is purchased before construction is complete, and in many cases before construction has begun. Buyers typically make deposits according to a schedule and pay the remaining balance at closing.
What is the difference between pre-construction and new construction?
Pre-construction generally refers to projects that are planned or currently being built. New construction can also include recently completed properties with developer inventory or first-owner opportunities.
Are completion dates guaranteed?
No. Developer completion dates are estimates and can change because of permitting, construction, financing, weather or other factors.
Are prices negotiable with developers?
Sometimes. Depending on the project and stage of sales, developers may negotiate price, deposits, upgrades, closing-cost incentives or other terms. In stronger-selling projects there may be little or no negotiation.

Do I pay more if I use a Realtor?
Broker compensation varies by project and transaction and will be disclosed before you move forward. In many new-development transactions, developers offer compensation to cooperating brokers, but the structure should always be confirmed for the particular project.
How do I compare two new developments?
I look at more than the starting price: developer history, location, price per square foot, unit layout, views, deposit schedule, maintenance costs, rental policy, construction timeline, competing supply and intended use of the property.
Do I need a real estate attorney?
Developer contracts can be lengthy and differ from standard resale agreements. I can assist with the real estate process, but legal and tax questions should be reviewed by qualified attorneys and tax professionals.

3How much money do I need for a deposit?
Deposit schedules vary significantly by development. Some projects require deposits in several installments as construction progresses. I can provide the current deposit structure for any project you’re considering.
Can I finance a pre-construction condo?
Yes, financing may be available at closing depending on the property, lender and buyer. Construction deposits are generally made before closing, and financing requirements can differ substantially from a traditional resale purchase.
What closing costs should I expect?
Closing costs vary substantially by development because developer contracts may allocate expenses differently from traditional resale transactions. Buyers should review the contract and estimated closing statement carefully.

It depends entirely on the development. Some projects permit short-term rentals, while others require six- or twelve-month leases or limit the number of rentals per year. Rental policy should be reviewed before purchasing.
Can I assign my contract before closing?
Some developers allow assignments and others prohibit or restrict them. The purchase agreement controls.

1Can purchasing a Miami development qualify me for the EB-5 program?
Potentially, but purchasing an individual condo or residence does not by itself qualify someone for EB-5. Some Miami real-estate developments are associated with separate EB-5 investment offerings through qualifying new commercial enterprises and, in many cases, regional centers. EB-5 eligibility depends on the specific investment structure and the investor meeting all USCIS requirements. An approved regional-center project filing does not guarantee approval of an individual investor's petition or a green card.
